Every now and again, even today’s children need a dose of reality to let them know they can’t always get what they want.

For a group of children dedicated to climate change, that reality came crashing down after an appeals court tossed their case against President Trump.

Sorry, Not in This Court

The case itself has been kicking around in the courts since 2015.

Juliana v. United States wants to hold the government accountable for not having an “enforceable national remedial plan” to address carbon emissions.

Since Trump took office, the media, however, has spun this case as being a direct lawsuit against Trump rather than a case that just happened to come to roost while he was in the Oval Office.

In 2018, the case made its way to the Supreme Court, which is when the new narrative started to get spun up on it.

Rather than outright dismiss the case, the Supreme Court decided to kick the case back to the 9th Circuit Court of Appeals.

While this particular circuit has seen a bit of a remake under the Trump administration, it is still dominated by bleeding heart liberals.

Shockingly, even though the court sympathized with the case, the court came to the ultimate conclusion administration policy issues should be fought out in Congress, not the courts.

The appeals panel collectively stated, “The panel reluctantly concluded that the plaintiffs’ case must be made to the political branches or to the electorate at large.

“The political branches might conclude—however inappropriately in the plaintiffs’ view—that economic or defense considerations called for continuation of the very programs challenged in this suit.”

But What About…

The ruling here is very interesting because had that same standard been applied to any of the immigration cases that have come before the courts, this administration would not be so bogged down in legal cases.

I cannot help but ask if the courts are not where administration policies are to be won or lost, then why are so many courts able to place stays on Trump administration immigration policies?

A perfect example of this is the recent decision by a federal judge in Maryland to block the administration policy of allowing states to decide whether or not they want to accept refugees.

As you can see, the legal system is great when politics are removed from the process.

Sadly, far too many judges today are looking to make more of a political statement rather than a fair and just decision based on our actual laws and Constitution.

  1. After Trump’s 8 years in the WH he will have placed about 50% of the federal judges. Maybe then we can get real justice in the courts. We need to give someone like Trump the WH in 2024 so our country can continue to prosper.

  2. Well whoever pressed this court case with money more than likely donated by Soros I’m glad they lost. Unfortunately the fact that the courts kicked it back to Congress I doubt you’ll see any redress on the issue since they can’t seem to figure out how to tie their own shoes and less likely want to get involved.
