With election day coming very close, the focus is starting to shift for the GOP.

There is a window that opens up when the last ballot is cast and that closes if the GOP takes over Congress.

That, of course, is Merrick Garland announcing an indictment of Donald Trump.

Weeks Away

As soon as the midterms are over, Donald Trump is expected to announce that he is running for president.

If Garland waits too long, it would be construed as a political move.

Point being, Garland will only have a window of a few weeks to announce it.

If he does not announce after the midterms are over, my guess is that he waits to make it a true election bombshell by holding off as long as possible to really hurt Trump.

After all, if it will be perceived as a politically motivated indictment, why not get the biggest impact?

Having said that, the consensus is that it will be sooner rather than later.

One veteran Republican aide stated, “A couple of weeks after the election, I assume that Garland will indict Trump.”

Another aide stated that he thought it could actually help Trump.

He stated, “People have been talking about splintering support and dampening enthusiasm among Republican voters for him.

“An indictment could actually galvanize and reunify Republicans around him.”

If Trump gets indicted, it will likely be under the espionage act, which I do not see as being successful.

Jeffrey Robbins, a former federal prosecutor, disagrees, stating, “I think that the Espionage Act violations are relatively straightforward, even self-evident, and that the Department likely already has substantial evidence of obstruction of justice.”

There is zero proof that Trump took those documents for personal gain, so I am not sure what is so straightforward on that front.

This riddle will be solved soon enough.
