During the last week of September, Donald Trump’s legal team made its move to have Judge Chutkan removed from the bench.
The problem is that she had to make the call.
She has just answered the motion to recuse herself from Trump’s case, and it’s not good.
Motion Denied
Trump’s legal team pointed to numerous cases where Chutkan has clearly referenced Trump in a biased way.
For instance, in one case, she stated, “[T]he people who mobbed that Capitol were there in fealty, in loyalty, to one man – not to the Constitution, of which most of the people who come before me seem woefully ignorant; not to the ideals of this country; and not to the principles of democracy.
“It’s a blind loyalty to one person who, by the way, remains free to this day.”
After seeing the filing and reading the objections, Judge Chutkan responded, “[T]he statements certainly do not manifest a deep-seated prejudice that would make fair judgment impossible — the standard for recusal based on statements with intrajudicial origins.”
Her ruling continued, “[T]he court expressly declined to state who, if anyone, it thought should still face charges.
“It is the defense, not the court, who has assumed that the Defendant belongs in that undefined group.
“Likewise, for the sentencing hearing in Priola, the defense purports to detect an ‘inescapable’ message in what the court did not say: that ‘President Trump is free, but should not be.'”
Her reasoning is utter bullsh**, as it was clear that in every case, she was referring to Trump.
She knows the rules, however, and by not naming Trump, she can say it could have been anyone who was backing Trump’s claims at the time.
I know she wants to crush Trump, but she better be very careful with her rulings on the bench because if she gets overzealous, she is setting up Trump for a win on appeal.
As a matter of fact, I would bet that is what his attorneys are counting on.
