Congresswoman Elise Stefanik (R-NY), the third most powerful member of Congress as the GOP Conference Chairwoman, representing Upstate New York’s District 21 is leveling a serious charge of obstruction at House Speaker Nancy Pelosi in a statement released August 15th. If the allegations are true, then action needs to be taken against Pelosi immediately for the illegal obstruction of her congressional colleagues pursuant to 18 U.S. Code § 1505, ironically the same provision they attempted to invoke in the first impeachment of President Trump.
The applicable portions of the statute are:
“Whoever, with intent to avoid, evade, prevent, or obstruct compliance, in whole or in part, with any civil investigative demand duly and properly made under the Antitrust Civil Process Act, willfully withholds, misrepresents, removes from any place, conceals, covers up, destroys, mutilates, alters, or by other means falsifies any documentary material, answers to written interrogatories, or oral testimony, which is the subject of such demand; or attempts to do so or solicits another to do so;[…] Shall be fined under this title, imprisoned not more than 5 years or, if the offense involves international or domestic terrorism (as defined in section 2331), imprisoned not more than 8 years, or both.”
Nancy has some explaining to do, at the VERY LEAST she needs to answer to an ethics inquiry.
The Statement From Congresswoman Stefanik
“On this morning’s bipartisan conference call regarding Afghanistan with Secretaries Austin, Blinken, and Chairman Milley, Authoritarian Speaker of the House Nancy Pelosi blocked me and multiple Republican Members from asking questions and lied and said, “there were no further questions in the queue.”
“I sit on the House Armed Services Committee, the House Permanent Select Committee on Intelligence, and represent the 10th Mountain Division at Fort Drum, the most deployed US Army division since 9/11. I have led and participated in multiple bipartisan delegations to Afghanistan.
“My questions were the following:
1. How many US citizens do we have left to evacuate? When will that mission be completed?
2. Afghan Security Forces had best military equipment and capabilities possible, what is US military and intelligence assessment of Taliban now having operational control of those assets and capabilities?
3. There is reporting that US is paying vast sums of cash to Taliban in exchange for allowing the evacuation to proceed. Is this true?
4. What steps are being taken to ensure the billions of reserves in the Afghanistan Bank are not accessed by the Taliban?
“This Lame Duck Authoritarian Speaker of the House is shielding a feckless, weak, and failed Commander in Chief and his Administration. Nancy knows that this is Joe Biden’s Saigon.”
Stefanik has a lot to complain about here, what she’s asking are FUNDAMENTAL questions that are extremely important to her oversight role on the House Permanent Select Committee on Intelligence as well as her position as GOP Conference Chair. If the third-ranking Republican in the House can’t get the time of day from the Speaker, can’t even get four questions answered on a Zoom call, then the function of our Congress is broken at an extremely basic level and it is little more than a partisan stamp on the Biden-Harris agenda.
