With a Trump-appointed judge on the bench, there is no way Trump’s legal team thought they were coming out of this hearing with anything other than a win.
Judge Cannon just put a wet blanket over their party, however.
Cannon did not make a bench ruling on the request for a special master.
Instead, she said it will come in due time.
Another Delay
This is forcing yet another delay in this case moving forward.
With no decision from Cannon, the DOJ is forced to sit back and wait, as is the Trump camp.
If Cannon eventually permits the special master, it will probably take weeks before documents start to get reviewed.
The two sides will have to narrow down a list of individuals qualified to review the documents, including top-level security clearance.
Once they do that, they will have to agree on one person to do the review.
Then, of course, that individual will have to take the time to review all the documents, which will probably take weeks.
Cannon seems inclined to rule in Trump’s favor, asking prosecutors, “What is the harm of appointing a special master?
“What is your articulation of harm other than the general concern that it would delay a criminal investigation?”
The harm comes if the special master finds any additional documents than what the DOJ has already separated.
If they are found to still have privileged documents in hand, well, they may have just as many legal problems as Trump.
