Donald Trump and Judge Merchan are officially at war.
Several days ago, Judge Merchan announced that he would be sentencing Donald Trump on January 10.
Trump has since filed a motion to have the sentencing delayed after his motion to have the case dismissed failed.
Presidential Immunity
Judge Merchan announced that the sentencing hearing would go on as planned.
However, he stated that he would not be sentencing Trump to jail.
Merchan is going to issue an unconditional discharge, which means no punishment for Trump, but he will be a convicted felon.
Trump Spokesman Steven Cheung announced the motion to push this back again, stating, “Today, President Trump’s legal team moved to stop the unlawful sentencing in the Manhattan D.A.’s Witch Hunt.
“The Supreme Court’s historic decision on Immunity, the state constitution of New York, and other established legal precedent mandate that this meritless hoax be immediately dismissed.
“The American People elected President Trump with an overwhelming mandate that demands an immediate end to the political weaponization of our justice system and all of the remaining Witch Hunts.
“We look forward to uniting our country in the new administration as President Trump makes America great again.”
Merchan then denied the motion, which led to Trump filing an emergency motion with the Supreme Court.
I believe Trump will fail there as well because presidential immunity is not relevant to this case.
Trump was not in office when he committed the crime, and even if he was, it was a business crime and had nothing to do with the presidency.
This is about as cut and dry as it gets, but I would still not be surprised to see Alito and Thomas side with Trump if it gets that far.
Another problem for Trump is that Justice Sotomayor oversees New York appeals, so I would not expect her to even take the case.
And if this goes down as I suspect, I expect nothing but venom to come from Trump and Cheung.
