Trump Stuns Alvin Bragg

With Donald Trump’s sentencing hearing in the Alvin Bragg hush-money case in about two weeks, Trump is hoping to make a big move to flip the ruling in the case.

To that point, Trump’s attorneys have filed a motion to have the case moved to federal court.

Trump is doing this in the hopes of having the charges dismissed based on presidential immunity.

Dismissing the Case

The entire argument of Trump’s attorneys centers around presidential immunity.

While the media had played up the recent decision by the Supreme Court on this front, nothing really changed.

All the court did was reaffirm that official presidential acts cannot be prosecuted.

The problem for Trump is that the hush-money payments and the ledger entries that constituted fraud were not presidential acts.

Even if Trump had been in office at the time, which he was not, this would have been considered the act of a private businessman or citizen, not an act that fell under the purview of the president of the United States.

That being the case, there is no way this case will ever be dismissed based on that ruling.

Trump’s attorneys are also claiming election interference, arguing, “Immediate access to such a forum is imperative and of the utmost urgency.

“Federal institutional interests associated with the Presidency, Congressional and FEC regulation of federal elections, and the integrity of the upcoming 2024 Presidential election are at stake.”

I want to be clear that I think these charges were a joke, as cases such as this are usually pleaded out with a small fine.

And I have always stated that I think the case will be overturned on appeal or, at the very least, the penalties and sentence severely reduced.

Having said that, while Trump would love to see this case moved and dismissed, I don’t think he is going to win this battle.
