Dems Lose Major Legal Battle

House Democrats were issued a massive blow to their impeachment effort this week.

In a 2-1 decision, the U.S. Court of Appeals in D.C. ruled that former White House Counsel Donald McGahn cannot be called to testify before Congress.

HUGE Win for Trump

I have absolutely no doubt Democrats are going to whine in the media about this.

McGahn is atop the list of doomsday witnesses for the likes of Reps. Nadler and Schiff, but now they are going to have to figure out another way to get at Trump.

They were convinced McGahn could help them spin the Mueller report against Trump, but that is obviously not going to happen now.

This, as you may recall, is one of the many cases the Dems did not allow to play out, and now we know why. 

The ruling by the appeals court, however, is not the only bad news for Democrats.

Obama’s Precedent

The Department of Legal Counsel has stated that McGahn has “immunity,” and Democrats have Obama to thank for it.

In July 2014, a similar situation arose when David Simas, the Director of the Office of Political Strategy and Outreach, was being called before Congress.

At that time, Obama’s DOJ ruled that “the President’s immediate advisers are absolutely immune from congressional testimony process.”

This, in fact, was not the only time this decision was handed down by a Justice Department.

The original ruling was set in 1971 from then-Attorney General William Rehnquist.

This should not only be the end of their quest, but it should also prove to the American people the Dems are using nothing but smoke and mirrors in this quest to have Trump removed from office.
