Fulton County District Attorney Fani Willis in Georgia is now face to face with a difficult legal situation that is likely to land her in some hot water. Former White House Chief of Staff Mark Meadows attempted to have his charges removed to federal court, which turned out to be unsuccessful, leading him to file an appeal with the 11th Circuit Court.
The 11th Circuit Court is now requesting for a brief from Willis regarding whether or not federal officials are eligible for immunity such as in this case being sought by Meadows, who is a former GOP congressman from North Carolina.
Georgia State Law professor Anthony Michael Kreis says that even if Willis wins the review, it will be short-lived and meaningless.
He believes that this appeal would open the door for more confusion and may lead to Supreme Court review.
Therefore, he suggests that she should turn down the invitation in order to avoid any derailment of litigation or upending of removal statutes.
Kreis commented on X platform saying: “I think this is a trap that Fani Willis should not walk into…Willis should shut this down despite it maybe giving Meadows a defeat…It makes little theoretical sense.”
He concluded by recommending that Willis “politely decline” the invitation to derail litigation and upend the removal statute”.
Bradley Moss concurs with Kreis’ opinion on this matter.
Willis should shut this down despite it maybe giving Meadows a defeat. First, it is a nasty kind of textualism that conservatives like and liberals should reject. Second, it introduces more unnecessary confusion and opens the door to a greater likelihood of Supreme Court review.

Former President Donald Trump is also likely to try and move his case to federal court due to allegations he colluded with 18 others in order to overturn election results in Georgia.
His legal team is expected to seek dismissal of charges under the guise that Trump was acting in an official capacity as president when committing these acts and so should be immune from such proceedings according CNN legal analyst Elie Honig.
Mark Meadows attempted this move but was unsuccessful. Therefore Honig argues that it will take much work on behalf of all 19 defendants involved before any low-hanging fruit can be picked off or flipped due them working together towards an illegal end.
Willis should politely decline the invitation to derail litigation and upend the removal statute.
