While Joe Biden’s handlers try to figure out what to do with the migrant horde already released into America’s heartland, the left-leaning network media is frantically ignoring a major story. On Wednesday, U.S. District Judge T. Kent Wetherell ruled the current policy of “catch and release” is totally illegal. This decision, all by itself is a major victory for conservatives and there’s another suit just like it challenging the legality of the Biden “parole” scheme. Florida’s ruling could affect the other suit in a good way. The big nightmare for everyone is figuring out what to do now.
Migrant mayhem in wake of ruling
Each and every asylum seeking migrant already in America was just given notice they’re supposed to be in custody. Joe Biden and Alejandro Mayorkas have a week to challenge the ruling with an appeal before it goes into effect. It’s expected to stand up in court, though. It’s pretty clear that Homeland Security usurped the role of Congress.
Florida’s Attorney General, Ashley Moody, broke out the Champaign to celebrate. “This is not just a win for Florida. This is a win for our country to have a judge come in and say what we have been saying all along.”
Judge Wetherell put in writing exactly what’s been on the minds of most conservatives for a really long time. He went scorched earth in his scathing and lengthy analysis. Moody pointed out the good parts.

“A federal judge has now said, basically, Biden broke the border, his policies, his request for less detention has allowed millions to come in without following federal law.” That may be bad for the migrant community but it’s “a win for the rule of law, which is the basic tenet on which our government by the people is built.”
The official term for the game of migrant catch and release is “alternatives to detention.” The court determined that DHS simply made that up on their own. Even “ankle bracelets and other monitoring,” such as cell phone tracking, won’t meet the legal requirement for lock-down.
Judge Wetherell knew his decision was going to start mayhem, so he put an automatic one week hold on it before anything goes into effect. He expects Democrats to have it “kicked upstairs” over his head. That’s fine, bring it on, he invites.
A meaningless line in the sand
The court used a lot of highly descriptive language in it’s ruling. “The Court finds in favor of Florida because, as detailed below, the evidence establishes that Defendants have effectively turned the Southwest Border into a meaningless line in the sand and little more than a speed bump for aliens flooding into the country.”
Migrant aid groups are screaming at their television sets but don’t have a clue what to tell their clients.
If this stands, it means that every single loose migrant wandering the streets of America needs to be locked in a detention center. They’ll sit in a cage with a foil space blanket until someone decides to either let them in, the proper way, or deport them back out. All the ones in process now will need to be held right where they’re at. That should add to even more confusion with the CBP-One App. It was clear to the Court that this is entirely Joe Biden’s crisis.

“Collectively, these actions were akin to posting a flashing ‘Come In, We’re Open‘ sign on the southern border. The unprecedented ‘surge’ of aliens that started arriving at the Southwest Border almost immediately after President Biden took office and that has continued unabated over the past two years was a predictable consequence of these actions.”
Ms. Moody is elated by her victory. “One of my favorite lines in this order is when the judge was saying all of the evidence shows Biden’s policies caused this surge, caused millions to come in.”
The judge, she notes, also “said, ‘Look, you asked for less detention, you didn’t follow the law, Biden, and now to blame it on not having the detention is like a child killing its parents and then asking for pity because it’s an orphan.‘” Migrant rights advocates are melting the DHS phone lines but not getting much further than that.
